Your will should preferably be drawn up by an expert.
Any person over 16 years of age is free to make a will in order to determine how his or her estate should devolve upon his or her passing. If you die without a will, your estate will devolve in terms of the rules of intestate succession.
It is particularly important to have a valid will if you have minor children so that you may address matters relating to their guardianship and care in the event of your death. In this regard, it is important to nominate a person who you wish to become the guardian of your children and to tell that person of your wishes relating to your children. Making a will also presents you with an opportunity to acknowledge and provide security for your loved ones and to provide gifts to charities close to your heart, should you wish to do so.
